JOB SUMMARY:
The Senior Contracts Engineer is responsible for the management of contracts by rendering contractual support in the form of drafting contractual correspondences, evaluation of changes/variations and on processing Change Requests, and issuing Variations/Amendments.
PRIMARY DUTIES & RESPONSIBILITIES:
- Review and study all contract conditions and provide contract analysis that includes summary reports to each concerned party (Technical, Cost, and Planning, etc.) to prepare the requirements needed to start the project.
- Responsible for all the correspondence going back and forth between the client and the company, and provide a list of official letters with their current status in the form of a contractual log to keep track of the project progress, issues, and risks either for info or any action needed.
- Administrate variation orders when the client requests Variations out of the contract’s scope, and discuss it with the procurement team for quotation and price breakdown.
- Handle and submit claims when the project deviates from the original time schedule and budget, and prepare a notice of claim with a list of all delayed events to be issued according to the contract time bars to preserve the company's rights for extension of time and money.
- Make necessary amendments to the contracts mutually with the client,
- Monitoring Subcontracts: issuance, signature, and Administration; through ensuring compliance of subcontract conditions (back-to-back basis) with the Main contract, drafting special conditions (if required), and preparation of deviation reports.
- Present monthly project status report to the management that entails progress, variation, and claims log for comparison with the previous months for any needed precautions or actions.
- Manage subcontracts in assessing claims and issuing correspondences to deliver quality standards agreed upon in a timely manner.
- Appraise Contractual Documents, Allocate Potential Risks, and Provide Legal/Contractual Countermeasures during the Tender Stage.
- Ability to work with a team at all levels of the organization to develop Major Claims.
- Monitor EMECO’s contracts and its obligations to 3rd parties.
- Develop and institutionalize EMECO’s contractual legal know-how and capabilities
- Perform any other related tasks as assigned.
Job Requirements
MINIMUM QUALIFICATION & EXPERIENCE:
Essential
- Bachelor’s degree in Engineering. CLAC Certificate for (Contracts Engineer) is a Plus.
- 6+ years of experience in the same role.
- Strong understanding of contract requirements and the preparation of RFPs and RFIs for the purchase of equipment and construction services.
- In-depth knowledge of construction principles and practices is required.
- Strong proficiency in compiling and presenting written project status reports to executive leadership.
- Strong knowledge of EPC contracts is a MUST.
- Familiarity with FIDIC contracts is a MUST.
- Familiarity with Saudi Arabian construction regulations.
- Proficient use of Microsoft Office Applications, Auto-CAD, and Primavera.
- Strong knowledge of local laws and regulations in Saudi Arabia.
- Excellent communication and interpersonal skills.
- Problem solving, including structuring problems, performing detailed analysis, and developing & and implementing recommendations.
- Knowledge of basic accounting and finance principles.
- Knowledge of procurement strategies and pre-contract procedures.
- Excellent Negotiation skills, persuasion, and judgment skills
- Strong research skills and an in-depth understanding of financial analytics and legal agreements.
- Fluent in Arabic and English.
- In-depth understanding of all common forms of contracts, claims, and laws pertaining to contracts.
Preferred Qualifications
- Relevant experience in the Saudi Market is preferred.
- Legally qualified (Law Degree/Certification) a plus.
