Job Description
- Provide professional advice, expertise and practical assistance to all departments in all tendering – contractual matters from inception of project till closeout of contacts.
- Finalize tender documentation including specifications preparation and pricing mechanism & release for tender.
- Maintain contractual records and documentation.
- Guide sponsoring department on the review of the content of tender bulletin, tender clarifications.
- Participate during evaluation of tenders, commercial negotiation with tenderers.
- Serve as the point of contact for owners and prospective contracts.
- Prepare award plan submissions and letter of awards
- Prepare draft contract document (Fidic Forms – Ad-hoc forms) by incorporation the effect of all tender bulletin, negotiations, clarifications, and qualifications accepted by cooperation
- RFPs to prospective contractors
- Review work/service scopes of tenders & change requests and liaise with sponsoring department for improvements & changes
- Manage contracts by rendering contractual support on resolving disputes, evaluation of claims, variation and settlement of final account
- Ensure compliance with contracts procedures and support project Execution Procedures
- Provide quantity surveying and materials quantities take off.
- Provide cost estimate.
- Prepare suitable tailor-made pre-qualification documents, invitations, and evaluation criteria and render expert advice to SDs in shortlisting potential bidders.
- Identify the most suitable pricing mechanism for a given scope of work, i.e. lump sum, re-measured, cost-plus, escalation factor, exchange fluctuations etc. taking into consideration the intended contract duration.
- Provide expert advice and direction to Sponsoring Department (SD) during tender preparation to ensure that the most and managed in accordance with MNHD HSE risk management guidelines.
- Ensure that the bid evaluations are conducted in a fair and ethical manner and are consistent with the terms and conditions of tenders.
- Render practical assistance during commercial negotiations of bidders with MNHD management, for effective negotiation including preparation of management briefs.
- Evaluate critically all claims raised by contractors and advise SD of the admissibility or otherwise of the same.
- Apply change management and claims prevention expertise in the management of high-value contracts
- Review the existing process of the claims management and dispute resolution,
- Evaluate Claims and Extension of times issues – Loss & Expense Claims from contractors and advice tender committees.
Job Requirements
Candidate Profile:
- Bachelor degree in engineering.
- From 15 to 20 years of experience.
- Possession of sound knowledge of Contracts law is a must.
- Wide knowledge and experience in FIDIC 87 and FIDIC 99 forms and applications.
- Computer literate and able to use this knowledge for contract analysis, evaluation of statistical data both historical and projected.
- Certificates: CLAC/ CAPM
- Excellent user of Primavera, MS Project.
