The Head of Legal and Compliance is responsible for providing strategic and legal advice in (and for ensuring the legal sufficiency of) all matters that are relevant to business in Egypt, Morocco, Algeria, Tunisia, and Africa’s Export Markets, such as, for illustration, contracts (e.g. marketing, promotion, purchasing, consultancy, employment, etc), litigation, and employee relations. In addition, he/she is responsible for establishing, promoting, and reinforcing compliance standards, aligned with local laws and regulations and companywide compliance policies.

This experienced legal manager, with support and direction from the Emerging Growth Markets Head of Legal and Compliance, also provides strategic legal guidance and training in key legal areas.
As a member of Alcon Africa’s management team, the Head of Legal and Compliance adds value to the local business beyond purely legal matters.

Major Accountabilities :

  • Monitor & influence legal developments; ensure that the business considers legal trends & risks in the business strategy
  • Represent Alcon Legal to outside stakeholders the government & industry associations
  • Directly handle legal issues related to the surgical & VC businesses
  • Facilitates negotiations for agreements with distribution or on promotion & other services
  • Limit litigation risk exposure, including risk derived from distribution agreements, anti-trust issues & employee relations
  • Manage legal housekeeping
  • Ensure adherence to Novartis Outside Counsel Policy, develop the Country Outside Counsel Panel & manage external law firms
  • Manage Legal budget
  • Establish Compliance standards based on internal policies such as Code of Conduct, Corporate Citizenship guidelines, marketing practices & all applicable local laws and regulations
  • Oversee local requirements relating to national law & national industry codes and ensure that all business practices conducted in the country comply with such requirements & with the global minimal standards as contained in companywide policies
  • Facilitate the establishment & communication of local processes & SOPs, covering Promotional Content, Interactions with HCPs/Patients & Grants & any additional local requirements
  • Establish local annual training plans, covering compliance standards
  • Conduct on-boarding & refresher training on compliance standards, such as Code of Conduct, Corporate Citizenship guidelines, promotional practices and other relevant compliance related areas
  • Champion ethical tone throughout the organization, promote compliance standards through effective communication by involving Senior/Middle Management to leverage messages on compliance & maintain high level of awareness
  • Foster ethical behavior through inclusion of criteria related to compliance in associates Objectives / Incentives
  • Conduct compliance-related risk assessment
  • Develop measures to self-monitor the compliance program in the country & implement corrective actions
  • Ensure communication & implementation of BPO process for reporting allegations of misconduct
  • Investigate alleged misconduct based on allocation of responsibility by BPO
  • Support Management regarding disciplinary measures of misconduct
  • Consider appropriate ways by which associates learn about possible consequences of Compliance related misconduct or best practices
  • Engage in Global Compliance Initiatives such as the Compliance Network to share best practices/learning

Job Requirements

  • University degreein Law and Bar admission
  • Extensive experience in legal practice (> 8 years)
  • Preferably significant (> 3 years) experience in legal practice related to the pharmaceutical or medical device/technology industry
  • Proven ability to proactively provide insightful and timely legal support to stakeholders across a functionally and geographically-dispersed organization
  • Experience with corporate responsibility and with balancing global standards and local cultures
  • Arabic and English (French is a plus)
  • Excellent verbal and written communication skills
  • Speak up culture, persuasive negotiator and ability to influence internal and external stakeholders
  • Solid understanding of the medical device industry and customer needs with an ability to deduce the implications for Novartis and implement solutions
  • Strong leadership skills
  • Sound experience in litigation
  • Passion for business integrity topic and impeccable integrity track record
  • Strong knowledge of compliance issues facing Novartis/Alcon businesses
  • Ability to represent Alcon externally on integrity / compliance topics
